He says that “if there is pain in the animals that’s painful for the horses and people to watch.”
When confronted with the evidence that he had threatened animals, he insisted that he meant just that, that he was not going to “do these things”.
At an unrelated court hearing earlier this week, the court heard that Mr Dyson was charged with animal cruelty by two police officers in 2008 for repeatedly shoving horses by the heels so the hindquarters slammed into the ground.
In 2012, Mr Dyson, then aged 43, pleaded guilty to 12 breaches of a section of the Dangerous Dogs Act following a complaint from the Yorkshire Post.
He also pleaded guilty in that case and was sentenced to 90 days in prison.
Mr Dyson says that in the latest case, he has been charged by police at a court in Newcastle – but is yet to find out what charges, if any, he is facing.
He says the latest incident should not be regarded as a crime, as he had just been given a warning after an earlier incident.
Police have not returned calls to the Telegraph seeking their view.
They have not responded to any further attempts by The Telegraph to contact the officers.
A spokesman for the Metropolitan Police said: “Mr Dyson has never been charged with any offence relating to a horse, he just recently received a warning after an incitement to animal cruelty charge was recorded. But he has never been prosecuted with that offence – and we’re not aware that police have made any referral to us in relation to him.”
A spokeswoman for the National Animal Welfare Institute (NAWI) (which represents animal rights groups which oppose the ban) said: “There will always be the argument. Will an animal be able to do something? Yes. Will it? No. But is the use of a whip a form of violence and what it represents? Yes.”
A spokeswoman for the North East Wildlife Authority said “the animal was a domestic heifer and that Mr Dyson’s behaviour was clearly abusive and dangerous”. She added: “There was a very clear warning issued to Mr Dyson by the authority as a result of this incident. He was subsequently issued with a warning for repeated breaches of the Dangerous Dogs Act.”
